All 59 Democrats and the 1 Independent Senator Bernie Sanders of Vermont voted to confirm. 91-year-old Robert Byrd of West Virginia who has been in frail health was brought in in a wheelchair for the vote. Edward Kennedy, suffering from brain cancer, was the only senator absent.
